Finatic provides financial data integration services, including but not limited to API access to portfolio tracking tools, order execution capabilities, and account information. Our Services are designed to help businesses and individuals access and utilize financial data for various purposes.

3. User Accounts

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify Finatic immediately of any unauthorized use of your account or any other breach of security.

4. Fees and Payment

Some of our Services may require payment of fees. All fees are stated in US dollars unless otherwise specified. You agree to pay all applicable fees for the Services you use as described on our website or within the Services.

Finatic reserves the right to change its fees at any time. Changes to fees will be posted on our website or communicated directly to users and will take effect at the time specified in the notice.

5. User Conduct

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe the rights of any third party
  • Transmit any material that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Finatic or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without the prior written consent of Finatic.

7. Third-Party Services

The Services may contain links to third-party websites or services that are not owned or controlled by Finatic. Finatic has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Finatic shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FINATIC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

IN NO EVENT SHALL FINATIC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Finatic and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Services.

11. Termination

Finatic may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

12. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

Finatic reserves the right, at its sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

14. Confidentiality and Protection of Proprietary Information

14.1 Confidential Information

You acknowledge that, in connection with your evaluation or use of the Service, we may disclose or you may otherwise obtain access to non-public information, including but not limited to architectural concepts, security models, integration methods, product designs, technical workflows, prototypes, roadmap details, and business strategies ("Confidential Information").

You agree that:

  • All Confidential Information is the exclusive property of Finatic, and is provided solely for your internal evaluation and use of the Service.
  • You may not disclose, publish, or provide any Confidential Information to any third party without our prior written consent.
  • You may not use Confidential Information to develop, improve, or operate any competing product, service, integration, or technology, whether directly or indirectly.
  • You must use at least a reasonable standard of care to protect Confidential Information from unauthorized use or disclosure.
  • Your obligations regarding Confidential Information survive termination of your account or relationship with Finatic.

14.2 No Reverse Engineering / No Competitive Use

You agree not to:

  • Copy, reproduce, modify, translate, or create derivative works based on the Service, its architecture, documentation, SDKs, or any other materials we provide.
  • Reverse engineer, decompile, disassemble, or attempt to discover any source code, internal logic, or underlying design of the Service.
  • Use the Service, its documentation, or any information obtained from Finatic to build, improve, or provide any competing product or service, including but not limited to broker aggregation, financial data aggregation, payment services, portfolio syncing, or API-driven financial infrastructure.

Any use of the Service or Confidential Information for competitive purposes is strictly prohibited and constitutes a material breach of these Terms.

14.3 Protected Technical Information

All technical materials we provide — including, but not limited to, API designs, schema structures, polling mechanisms, webhook models, data normalization logic, client SDKs, connection flows, integration methods, architectural descriptions, and system diagrams — are Finatic's confidential and proprietary information.

You may not use, disclose, or apply any such information for:

  • developing or enhancing any similar or competing technology
  • replicating Finatic's architectural patterns
  • designing your own aggregator or API infrastructure
  • performing competitive analysis beyond internal evaluation

These restrictions apply regardless of whether such information is provided in writing, verbally, visually, through demonstrations, or during sales or onboarding calls.

Any violation of these confidentiality and protection provisions shall constitute a material breach of these Terms and Conditions and may result in immediate termination of your access to the Services, as well as legal action to protect Finatic's intellectual property and proprietary rights, including but not limited to injunctive relief and monetary damages.
